Terms & Conditions

1. Overview and General Information

1.1. This website and its services are operated by PongoTodo S.L. (“we,” “us,” or  “our”), registered under B21686290, with headquarters at Casa Pongotodo, Carrer  d'Eduard Toldrà, 11, Local 5, 08950 Esplugues de Llobregat, Barcelona, and contact  email bakery@pongotodo.com .
1.2. By accessing or using this website ( pongotodo.com ) or purchasing  products/services, you agree to be bound by these Terms, including this Terms of  Sale, Delivery and Returns policies, Terms of Service, and our Privacy Policy ([link to  Privacy Policy]).
1.3. These Terms govern your use of our website and purchase relationship with us  and supersede any prior agreements.

1.4. We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page. Continued use of the website after such changes means acceptance of the updated terms.
1.5. These Terms primarily apply to consumers; if you act on behalf of a business or legal entity, please consult Section 11 for the specific terms applicable to business customers.

2. Use of Website and Prohibited Conduct

2.1. You agree to use the website only for lawful purposes and in a manner that does not infringe or restrict the rights of others.
2.2. You shall not:
Use the site for illegal, fraudulent, or unauthorized purposes;
Upload or transmit viruses, malware, or harmful code;
Harass, discriminate against, or abuse others;
Misrepresent your identity or provide false information;
Reproduce, copy, sell, resell, or exploit any part of the service without express written consent.

2.3. Any violation may result in immediate suspension or termination of your access without prior notice.

3. Orders and Acceptance

3.1. By placing an order, you confirm that you are at least the legal age in your  jurisdiction or have obtained parental/guardian consent.
3.2. Orders become binding upon our sending an order confirmation via email.
3.3. We may refuse or cancel orders for reasons such as  product unavailability, pricing errors, technical failures, or suspected fraud.

3.4. Should a price adjustment be necessary after order confirmation, we will notify  you, and you may cancel your order without penalties.
3.5. All products are intended for personal, non-commercial use unless explicitly  agreed otherwise (see Section 11).
3.6. You agree to provide accurate, complete, and current account information and to  update this information as needed.

4. Pricing and Payment

4.1. Prices are displayed in Euros and include relevant taxes (e.g., VAT), unless stated  otherwise.
4.2. We reserve the right to alter prices or correct errors before purchase completion.
4.3. Shipping fees, if applicable, will be shown at checkout prior  to purchase confirmation.
4.4. Accepted payment methods include, Accepted payment methods include credit  and debit cards (Visa, Mastercard, American Express, Discover, Diners, CUP, JCB,  Maestro), Apple Pay, Google Pay) Payments are typically processed immediately  upon ordering.

4.5. Customs duties, import taxes, or other fees applicable in your country will be disclosed at checkout or otherwise communicated before shipping.

5. Delivery

5.1. Products are manufactured or prepared upon order. Delivery times on product  pages are approximate and subject to change.
5.2. In case of significant delays, we will notify you via email. You have the right to  cancel your order should delays be material.
5.3. Delivery is deemed complete upon physical receipt by you or a designated third  party.
5.4. We deliver exclusively throughout the European continent (including EU and  non-EU countries such as the UK, Norway, Switzerland, Iceland, etc.).
5.5. Standard shipping within Europe is free unless otherwise specified.

5.6. Orders typically ship within 1–3 business days after payment confirmation.  Transit times are approximately 2–5 business days depending on the destination.
5.7. Packages are usually sent to your nearest authorized pick-up location, and the  carrier will be identified at checkout.
5.8. If an order is not collected from the pick-up point within the timeframe stipulated  by the carrier, we reserve the right to charge return shipping costs and a handling fee  of EUR 15 (or local equivalent).

6. Right of Withdrawal and Returns

6.1. You have the right to withdraw from your purchase within 14 calendar days from  the day you or a third party you designate take physical possession of the goods,  without providing  any reason.
6.2. To exercise your right, notify us unequivocally in writing (preferably via email at  bakery@pongotodo.com) including your name and order number. Use of the  standard withdrawal form  is optional.
6.3. The withdrawal notification must be sent before the 14-day withdrawal period  expires.
6.4. You must return products without undue delay, and in any case no later than 14  calendar days after notifying us. Return items to:

6.5. Returned products must be unused, complete with all original packaging,  accessories, and documentation, carefully packed to avoid damage during shipment.
6.6. You bear the cost of return shipping unless the goods are defective or wrongly  delivered.
6.7. You are responsible for any diminished value of returned goods attributable to  handling beyond what is necessary to establish their nature, characteristics, and  functioning.
6.8. Upon receipt and satisfactory inspection of the returned goods, we will refund all  amounts paid including standard delivery costs, but excluding any additional costs  resulting from your choice of a shipping method other than the least expensive  standard shipping offered.
6.9. Refunds shall be processed using the same payment method originally used,  typically within 14 days after receipt of the returned items or proof of dispatch,  whichever is earlier.

7. Defects and Warranty

7. 1. We provide a two-year commercial warranty against manufacturing defects from  the date of purchase. This warranty excludes damage from misuse, accidents,  normal wear, or unauthorized repairs.
7.2. Statutory warranty rights may exist depending on your jurisdiction (e.g., EU/EEA  statutory warranty up to 3 years).  You must notify us as soon as you become aware  of any defect.
7.3. To make a warranty claim, please contact us via email at  bakery@pongotodo.com or by post to PongoTodo S.L., Casa Pongotodo, Carrer  d'Eduard Toldrà, 11, Local 5, 08950 Esplugues de Llobregat, Barcelona, including a  detailed description and photos if possible.

7.4. We will assess warranty claims and at our discretion may repair, replace, refund in full or part.
7.5. If the claim is invalid, you may be charged a handling fee of 20 EUR (or local equivalent) plus shipping costs for return of the item.

8. User-Generated Content and Feedback

8.1. By submitting any comments, suggestions, or other materials (“Content”), you grant us a worldwide, royalty-free, perpetual license to use, modify, reproduce, distribute, publish, and display such Content in any media.
8.2. You warrant that your submissions do not violate any third party’s rights and do not contain unlawful, defamatory, or harmful material.

8.3. We reserve the right to remove or edit Content that violates these Terms or is otherwise objectionable.
8.4. You accept full responsibility for the legality and accuracy of your submissions.

9. Limitation of Liability

9.1. Except in cases of gross negligence or willful misconduct, our total liability is  limited to direct damages up to the purchase price paid for the affected goods or  services.
9.2. We disclaim liability for indirect, special, incidental, consequential, or punitive  damages, including loss of profits or data.
9.3. Product images and descriptions are illustrative; actual items may vary due to  screen display or manufacturing variances.

10. Indemnification

You agree to indemnify and hold harmless PongoTodo S.L. and its affiliates, officers, agents, and employees from any claims, damages, losses, costs, or liabilities arising from your breach of these Terms or violation of laws or third-party rights.

11. Business Customers

11.1 If you purchase as a business or legal entity, and no separate contract exists, the following apply:
Payment is by invoice due within 15 days unless otherwise agreed. Late payments incur lawful interest.
You must inspect goods promptly and notify any defects without delay.

Liability is limited to direct damages capped at 50% of the purchase price; indirect or consequential damages are excluded.
Delivery terms default to Incoterms® 2020, which prevail over any conflicting Terms.

12. Termination

We reserve the right to suspend or terminate your access to services immediately if you breach these Terms. All accrued rights and obligations survive termination.

13. Severability

If any provision is invalid, unlawful, or unenforceable, it will not affect the validity of remaining provisions.

14. Governing Law and Dispute Resolution

14.1. These Terms shall be governed by the laws of Spanish law.
14.2. Consumers may pursue claims in their local courts as permitted by law.
14.3. We encourage amicable resolution of disputes; please contact us at  bakery@pongotodo.com .
14.4. EU residents may utilize the European Commission’s Online Dispute Resolution  platform at https://ec.europa.eu/consumers/odr/main/.

15. Intellectual Property Rights

All content on this website, including but not limited to logos, images, text, and software, is owned or licensed by PongoTodo S.L. and protected by intellectual property laws.

16. Changes to Terms

We may amend these Terms at any time; updates are posted on this page with the date noted. Your continued use confirms acceptance.
